No Recovery, No Fee Collection *

For most cases, when a debtor makes a payment to us, we deduct a 33.33% (1/3) fee from any gross amounts collected, then forward you the remaining 66.67% (2/3). If we don’t collect, you don’t pay. *You would be responsible for paying all expenses such as the court filing fees, but you would not have to pay any hourly attorney’s fees.

Please note that though most of our collections fees are 33.33% (1/3) fee from any gross amounts collected, the percentage is negotiable based upon the amount owed, the complexity of the case and the age of the debt.

If you prefer, our office also accepts cases on a flat fee and hourly basis.
 

Civil Litigation

Civil litigation can be a lawsuit to collect money, get property back that belongs to you, or to make someone keep their promise to you. Lawsuits take time, but they can be very effective to make people do what they are supposed to do under the law. Small Claims

Breach of Contract

Unsecured Recoveries

Debts such as Credit Card debts, unsecured loans, personal loans, and bills for unpaid services may be particularly difficult to collect because there is no collateral to secure the loan. Garnishing Wages

Repossession Issues / Repo’s

It is against the law in the State of Maine to repossess property if the repossession will cause a breach of the peace. Breach of the peace is a legal term that can refer to trespasses on property, damage to property, or threats/acts of violence. If you suspect that a breach of the peace will occur during a repo or a breach of the peace has already occurred, immediately cease any attempts to repossess the property and contact an attorney immediately.
 

Additionally, a repo in Maine is complicated by Maine’s Uniform Consumer Credit Code. Have you sent out the consumer’s right to cure notice? Did you wait the required time to send your notice? Did you send it the right way and wait the required amount of time? Did it say everything it needed to? What about UCC sales and deficiency notices?

Liens on Real Estate or Personal Property

Liens can be an extremely effective tool for recovering money owed on debts. Liens on property hinder people from selling and obtaining financing on their property. So payment or settlement of a debt may be attained when the person owing you money attempts to sell or obtain financing on that property. Credit Unions, Banks, Hospitals, Mechanics, Builders, Architects, Roofers, Well Drillers, Laborers, Engineers, Surveyors, Farmers, Excavators, Landscapers, Gardeners, Loggers, Electricians, Carpenters, Plumbers, General Contractors, Truckers, and many other businesses are generally entitled to reasonable payments for the labor they performed.
